What is a Safe Harbor 401(k) and how does it work?

A Safe Harbor 401(k) is an employer-sponsored retirement plan that automatically satisfies key IRS nondiscrimination requirements by requiring mandatory employer contributions. In exchange, business owners and highly compensated employees can contribute the maximum allowed each year without failing compliance testing.

Employers choose between two options:

Contribute 3% of pay for all eligible employees, regardless of participation.
Match 100% of the first 3% employees’ contributions, plus 50% of the next 2%.

For 2025, employees can contribute up to $24,500, with an additional $8,000 catch-up if age 50 – 59; 64+. Thanks to SECURE 2.0, participants turning age 60 – 63 during the plan year could be eligible for an even larger catch-up contribution of an additional $11,250, resulting in $35,750 total employee elective deferral.

Safe Harbor 401(k) plans give small businesses a simpler alternative to traditional 401(k)s, reducing the time and effort needed for plan administration. Unlike traditional 401(k) plans, Safe Harbor plans have built-in “safe harbor” features that bypass nondiscrimination testing by requiring employer contributions, simplifying compliance.

To be effective for the 2026 calendar year, most Safe Harbor 401(k) plans must be set up by October 1, 2026, and be ready to receive 401(k) elective deferral contributions.

Our plans come with auto-enrollment services. Contributions can take three different forms, the first two of which are matching. This means employees must make traditional or Roth 401(k) elective deferrals to their accounts to receive the matching contributions.
